The Assam government, to strengthen the institution of Muslim marriage and authorise Govt machinery as the registering authority of marriages and divorce, is to approve ‘Assam Compulsory Registration of Muslim Marriages and Divorces Bill, 2024’, to be placed in the upcoming state assembly session starting from August 22.

The decision was taken during the state cabinet meeting held at Lok Sewa Bhawan in Guwahati under the Chairmanship of Chief Minister Himanta Biswa Sarma.

“Earlier, the Muslim Marriages and Divorces Registration was conducted by the Kazis. This new bill will ensure that Muslim marriage registration will be conducted by the government, not Kazi. There will be no marriage registration below 18 years. The registration authority will be the Sub Registrar of Assam government,” Dr Himanta Biswa Sarma said, addressing a press conference at Lok Sewa Bhawan in Guwahati.

The Bill will pave the way to strengthen the institution of marriage and provide safeguards and benefits of legal presumption especially to women and prevent the menace of child marriages.

“The main aim of bringing this new bill is to fight against child marriage,” he added.

The Bill seeks to achieve the following objectives:

  • Prevention of child marriage.
  • Make it compulsory for all married couples to get their marriages and divorces registered. The marriages may be solemnised as per their ritual, usage and ceremony and declared as per provisions of the law.
  • This new Bill is made in the line of Civil Code of Procedure for summon, notice etc. to ensure and find out the truth of application of all related issues.
  • Benefit the common people and protect them from all odds and evils besides legal recognition of their marriage and divorce.
