2019 Assistant Teacher Recruitment Exam: The Lucknow Bench of Allahabad High Court has given a big decision on Friday regarding the 69000 Assistant Teacher Recruitment Examination. The Lucknow Bench of the High Court has ordered to prepare a new selection list by bypassing the selection list released on 1 June 2020 of the Assistant Teacher Recruitment Examination 2019 and the selection list of 6800 candidates of 5 January 2022. In this regard, the court has also decided, modifying the order of the single bench of 13 March 2023, that the candidate of the reserved category will be migrated to the general category if he comes in the merit prescribed for the general category.

This order of the High Court has given a big blow to the UP government. The High Court has also said that the benefit of vertical reservation given as per the instructions given by us, will have to be given to the horizontal reservation as well. Along with this, the court has asked to complete the process of issuing a new list within three months, without interfering with the decision of the single bench to reject the selection list of 6800 candidates in addition to the reserved category on January 5, 2022 in the course of this recruitment examination. The court has also directed that if any candidate currently working is affected while preparing the new list, then he should be given the benefit of the session so that the studies of the students are not affected.

This decision has been passed by a division bench of Justice AR Masoodi and Justice Brijraj Singh while hearing 90 special appeals including Mahendra Pal and others together. In the said appeals, the decision of the single bench dated 13 March 2023 was challenged in which the single bench had reconsidered the selection list of 69000 candidates as well as rejected the selection list of 6800 candidates dated 5 January 2022.

What was the decision of the single bench regarding reservation

In its decision, the single bench had said that it is correct to keep the candidates who have taken advantage of reservation in TET in the unreserved category on getting the cutoff marks of the general category because TET only makes a candidate eligible to appear in the assistant teacher recruitment exam. However, the single bench further said that the candidates who have taken advantage of reservation in the assistant teacher recruitment exam cannot be kept in the unreserved category.

The division bench made this amendment

The division bench has said in its decision that the reserved category candidate should be migrated to the general category on securing the marks of merit prescribed for the general category. The court has also said that the benefit of vertical reservation given as per our instructions should also be given to the horizontal reservation. Regarding reservation, Section 3(6) of the Reservation Act and Appendix-1 of Service Rules 1981 should be fully followed while preparing the new list.
